Andy Tindel is the managing attorney of the Tyler, Texas office of the Provost*Umphrey Law Firm, L.L.P. Andy has been a trial and appellate lawyer since 1985 and is a past Chairman of the Litigation Section of the State Bar of Texas.  Andy specializes in the preparation, trial and appeal of a wide variety of commercial damage claims and intellectual property litigation including patent, trademark and copyright infringement claims,  trade dress and false advertising suits, unfair competition and trade secrets litigation, corporate governance disputes, securities fraud class actions and other general business and commercial litigation.  In addition to his commercial litigation practice, Andy also handles selected catastrophic personal injury cases involving product liability claims, FELA litigation, trucking accidents, wrongful death actions, and general negligence cases in all state and federal courts throughout Texas.

For over 20 years Andy has frequently served as an advisor and local counsel for clients and attorneys with high stakes litigation pending before the United States District Court for the Eastern District of Texas and state courts throughout East Texas.  In 2007 the Texas Lawyer named Andy as one of only 4 "Top-Notch" Plaintiff's Personal Injury Trial Lawyers in the State of Texas.  Andy has also been recognized as a Texas Super Lawyer every year since its inception in 2003.  Andy is rated "AV" by Martindale-Hubbell and is tripled certified as a specialist by the Texas Board of Legal Specialization in the fields of Civil Trial Law and Personal Injury Trial Law and Civil Appellate Law in addition to holding the designation of Civil Trial Advocate conferred by the National Board of Trial Advocacy.

FEDERAL COURTHOUSE IN TYLER, TEXAS NAMED IN HONOR OF WILLIAM M. STEGER

The federal courthouse complex in Tyler, Texas was renamed "The William M. Steger Federal Building and United States Courthouse" in a dedication ceremony held on May 9, 2008.  Andy Tindel, Judge Steger's law clerk in the early 1980's, served as the Master of Ceremonies for the event which included speeches by Thad Heartfield, Chief Judge of the Eastern District of Texas, Congressman Ralph Hall, Congressman Louie Gohmert and Judge Steger's widow, Ann Steger. ANDY TINDEL RECOGNIZED AS A  TEXAS "SUPER LAWYER" FOR SIXTH STRAIGHT YEAR

Andy Tindel will be recognized as a Texas "Super Lawyer" in October 2008 issue of Texas Monthly magazine it was announced on May 5.  Tindel was initially named a Texas "Super Lawyer"in 2003, the first year the designation was created, and has been recognized as a Texas "Super Lawyer" every year thereafter. "Super Lawyer selections are based on peer nominations made by more than 70,000 attorneys across Texas. A panel of lawyers selected by Texas Super Lawyers editors made the final selections, and less than 5 percent of attorneys in Texas were chosen for this honor.

$285,000,000 SETTLEMENT OF EL PASO SECURITIES FRAUD LITIGATION APPROVED

Lynn Hughes, United States District Judge for the Southern District of Texas, recently approved the settlement of certain consolidated securities fraud claims proceeding under the style of Oscar S. Wyatt, Jr. v. El Paso Corporation, et al., pending in the United States District Court for the Southern Distict of Texas. The terms of the settlement approved by the Court requires El Paso and the accounting firm of Price Waterhouse Coopers to pay a combined total of $285,000,00, less an attorney's fee of $43,558,317, to El Paso shareholders based upon a plan of allocation approved by the Court.  In approving the award of attorney's fees, Judge Hughes found that class counsel obtained a highly favorable settlement for El Paso shareholders through extensive time, work and thought by class counsel.  ANDY TINDEL managing attorney of the Tyler, Texas office of the Provost * Umphrey Law Firm, L.L.P. served as counsel for Lead Plaintiff Oscar Wyatt and the class.  

$4,150,000 SETTLEMENT REACHED FOR INJURED OILFIELD WORKER

The United States District Court for the Eastern District of Texas recently entered a judgment in favor of an injured East Texas employee of Cactus Drilling Company against an out of state oilfield service company.  The employee was catastrophically injured when a "suitcase" cable tray attached to a slingshot drilling rig owned by Cactus Drilling folded over on top of the injured worker.  The settlement will provide for the injured worker's medical and rehabilitative care needs for the remainder of his life.  The injured worker and his family were represented by ANDY TINDEL of the Tyler office of Provost Umphrey.

HOLLYWOOD PREMIERE OF RAZORSHARP SET FOR JANUARY 10

The action feature RAZORSHARP, written and directed by Marcus Perry, will premiere at the Fine Arts Theater on Wilshire Blvd. in Beverly Hills the evening of Janauary 10.  RAZORSHARP, which was co-produced by Andy Tindel, features Cassady Freeman in the title role of Veronica Sharpe, along with the noted character actor, Michael T.
